As a tenant of Amber Valley Housing you will have a legally binding tenancy agreement

Types of tenancy
All Amber Valley Housing tenants will either be:
- An assured tenant;
- An assured short-hold tenant;
- A tolerated trespasser;
- A demoted tenant.
Assured tenants
Assured tenants can live in their property as long as they don’t break the tenancy agreement for example by:
- Falling into rent arrears;
- Causing anti-social behaviour.
Assured short-hold tenants
Assured shorthold tenants have a fixed term agreement, usually for six months. After this period we can recover possession of the property. These tenancies are usually used for people in temporary accommodation.
Demoted tenants
We can apply to court for a tenancy to be ‘demoted’ for a certain period of time, if a tenant behaves in an anti-social way. This will be confirmed in writing and usually lasts for a year. Demoted tenants have the same rights as assured short-hold tenants, and have no right to buy, to sublet or take in lodgers, transfer or exchange their home.
Tolerated trespassers
Tenants taken to court for rent arrears who fail to make the repayments that the court decides become tolerated trespassers. Occupiers can stay in the property with our approval as long as they pay to live there.
Tolerated trespassers have no right to buy, or right of succession. Tolerated trespassers need to apply to court to have the tenancy restored.
